REVISION: OCT 2026
SEMO Equipment maintains strict title ownership of all leased machines throughout the rental duration. Custody commences immediately upon signed bills of lading or equipment delivery confirmation at the job site. The customer assumes complete responsibility for continuous custody, safe staging, and authorized use from release through technical return check-in.
To the maximum threshold permitted by applicable state law, SEMO Equipment expressly disclaims liability for indirect, incidental, punitive, or consequential damages resulting from machine downtime, delayed deployment, site stoppages, or production shortfalls. The renting party agrees to defend, indemnify, and hold SEMO Equipment harmless from third-party property damage or personal injury arising from operational misapplication.
Equipment operators must be fully certified, competent, and compliant with all federal OSHA, state DOT, and municipal safety statutes. The lessee is obligated to execute daily operator-level maintenance, including fluid level verification, greasing pivot pins, tire pressure auditing, and visual structural inspections before daily machine startup.
These terms, operational contracts, and all disputes arising from lease or service agreements shall be governed exclusively by the laws of the State of Missouri, without regard to choice of law principles. Any legal action or formal claim shall be filed solely in state or federal courts situated in Scott County or the Eastern District of Missouri.
